1. Acceptance of Terms
These Terms & Conditions ("Terms") govern your access to and use of the POSKAZ point-of-sale system, including this website, the POSKAZ admin dashboard, the POSKAZ Android app, and the POSKAZ Windows application (together, the "Service"), provided by Leon Applications (PVT) LTD ("POSKAZ", "we", "us" or "our"). By registering for, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of a business, you confirm you have authority to bind that business to these Terms.
2. The Service
POSKAZ provides point-of-sale software for managing sales, stock, cashiers, branches and reporting, with support for offline operation, multi-currency pricing, and ZIMRA/FDMS-compliant tax invoicing. We may add, change, or remove features from time to time to improve the Service.
3. Accounts & Eligibility
- You must be at least 18 years old and legally able to enter into a binding contract to register a shop on POSKAZ.
- You are responsible for the accuracy of the information you provide and for keeping your login credentials confidential.
- You are responsible for all activity that occurs under your account, including actions taken by admins and cashiers you create.
- Notify us immediately at leon@leonapplications.com if you suspect unauthorised access to your account.
4. Subscription Plans & Billing
POSKAZ is offered on several subscription tiers (currently Lite, Starter, Business, Professional and Enterprise), each with its own limits on branches, POS devices, device types, cashiers and administrators, as described on our Pricing page. Each tier is available on Monthly, 3-month, 6-month or 12-month billing — the total price is the monthly rate multiplied by the number of months, unless a discount is stated at checkout.
- Subscription fees are billed in advance and are shown in USD; payments may also be accepted in ZWL at the prevailing exchange rate shown at checkout.
- Payments are processed by Paynow. By subscribing, you also agree to Paynow's applicable terms for processing your payment.
- Renewing before your current period ends extends your existing expiry date — you do not lose any unused time.
- Only your shop's designated platform administrator can change your subscription tier; your own shop administrator may renew the current tier for a different duration at any time from the dashboard.
- Fees are non-refundable except where required by applicable law, or where we agree otherwise in writing.
- We may change subscription prices with reasonable notice through the dashboard or by email; continuing to use the Service after a price change takes effect after your current billing period means you accept the new price.
- If a subscription is not renewed before it expires, access to the dashboard and POS app may be restricted until it is renewed.
5. Free Trial
New shops may receive a free trial period (currently 14 days) with full access to the Service. We may change the length or availability of the free trial, or limit it to one trial per business, at our discretion.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose, or to process transactions you know to be fraudulent.
- Attempt to gain unauthorised access to any part of the Service, other shops' data, or our systems.
- Reverse-engineer, decompile, or attempt to extract the source code of the POSKAZ apps, except as permitted by law.
- Interfere with or disrupt the integrity or performance of the Service.
- Resell or sublicense the Service without our written consent, other than through our official Agent Program.
- Upload content or data that infringes the rights of any third party.
7. Third-Party Services
The Service integrates with third-party providers, including Paynow (payments), SMS/email providers (notifications), and ZIMRA's Fiscal Device Management System (tax compliance). We are not responsible for the availability, performance, or acts or omissions of these third parties, though we will make reasonable efforts to assist if an integration causes an issue with your use of the Service.
8. Your Data & Ownership
You retain all ownership rights to the business data you enter into POSKAZ — your products, stock, sales, customers, and reports ("Your Data"). You grant us a limited licence to host, process, and display Your Data solely to provide and support the Service. We do not claim ownership of Your Data and will not use it for any purpose other than operating, maintaining, and improving the Service, or as described in our Privacy Policy.
You are responsible for the accuracy and legality of Your Data, and for maintaining your own backups of anything critical to your business, in addition to what POSKAZ stores.
9. Account & Data Deletion
Deleting your account is permanent. Once processed, we cannot restore your shop, products, transaction history, or reports. Some records may be retained beyond deletion only where we are legally required to (for example, financial and tax records under applicable Zimbabwean law), as described in our Privacy Policy. Deleting your account does not cancel an active subscription payment already processed by Paynow; contact us before deleting if you have a pending renewal.
10. Intellectual Property
The Service, including its software, design, logos, and documentation, is owned by Leon Applications (PVT) LTD and is protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, branding, or source code beyond what is necessary to use the Service as intended.
11. Suspension & Termination
- You may stop using the Service, or request account deletion, at any time as described in Section 9.
- We may suspend or terminate your access if you breach these Terms, misuse the Service, fail to pay subscription fees, or if required to do so by law.
- We will make reasonable efforts to notify you before suspending an account, except where immediate action is necessary to protect the Service or other users.
- Sections of these Terms that by their nature should survive termination (including Sections 8, 9, 12, 13 and 14) will continue to apply.
12. Disclaimers & Limitation of Liability
The Service is provided "as is" and "as available". While we work to keep POSKAZ reliable and accurate, we do not warrant that the Service will be uninterrupted, error-free, or that fiscal or tax outcomes generated through third-party integrations (such as ZIMRA FDMS) will always be free of error caused by those third-party systems. To the maximum extent permitted by law, POSKAZ and Leon Applications (PVT) LTD are not liable for any indirect, incidental, or consequential damages, including loss of profits, revenue, or data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the subscription fees you paid us in the three months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless Leon Applications (PVT) LTD, its officers, employees, and agents from any claim, loss, or demand, including reasonable legal fees, arising out of your use of the Service, Your Data, or your violation of these Terms or applicable law.
14. Governing Law
These Terms are governed by the laws of Zimbabwe. Any dispute arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts of Zimbabwe.
15. Changes to These Terms
We may update these Terms from time to time. We will post the revised Terms on this page with an updated "Last updated" date, and will notify you of material changes through the dashboard or by email where appropriate. Continuing to use the Service after a change takes effect means you accept the revised Terms.
